A significant number of Swiss banks were revealed to have been\ncolluding with US citizens to hide their earnings from the US government. FATCA\nhas, in fact, severely disrupted the Swiss banking industry. Switzerland’s “too\nbig too fail” banks, like UBS, have settled with the US government for sums\nthat are eye-watering, but will not severely disrupt their business.\nMedium-size and smaller Swiss banks are being forced to pay proportionally much\nlarger sums, whether or not they knew their clients were from the US. Many are\ngoing out of business. The small Swiss banks that survive this reckoning will\ncertainly think twice before they ever deal with US clients again. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nJudging from the fact that \u003Ca href=\"http:\/\/www.youtube.com\/watch?v=Y-EVF7CZt_w\"\u003Emy anti-FATCA video\u003C\/a\u003E has\nbeen viewed by about a 50th of the entire population of the Cayman Islands, the\nlegislation has been having the desired effect in other tax haven jurisdictions\nas well. We should admit that in this one respect, FATCA has been having the\ndesired consequence. Tax avoidance by Americans has become more difficult, and\nthat is a good thing. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nThis one positive result, however should not distract the\npublic from FATCA’s truly mind-boggling scope. FATCA is a sledgehammer that is\nbeing used where a toothpick was necessary. FATCA does not just go after\nSwitzerland and Cayman. It fundamentally re-orders the business of banking for\nevery country, and in every country. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\"\u003E\n\u003Cspan style=\"font-size: xx-small;\"\u003E\u003Cbr \/\u003E\u003C\/span\u003E\n\u003Cbr \/\u003E\n\u003Ca name='more'\u003E\u003C\/a\u003E\u003Cdiv style=\"text-align: justify;\"\u003E\nBriefly, every bank in the world is now required to report\nany US bank accounts to the US government. FATCA requires that every bank in\nthe world enter into a 50-page English language contract with the \u003Ca class=\"zem_slink\" href=\"http:\/\/www.hrblock.com\/free-tax-tips-calculators\/tax-help-articles\/General-Filing\/IRS-Contact-Information.html?action=ga\u0026amp;aid=64623\u0026amp;out=vm\" rel=\"handrblock\" target=\"_blank\" title=\"IRS Contact Information\"\u003EUnited States\nInternal Revenue Service\u003C\/a\u003E. These agreements and their associated on-line\nreporting system will change according to the whims of the IRS and the Treasury\nDepartment. The regulations governing this system are over 400 pages long, and\nhave been subject to almost monthly revisions. Implementation starts in July of\n2014, and will quickly become the subject of US and international litigation.\u003C\/div\u003E\n\u003Cdiv style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv style=\"text-align: justify;\"\u003E\nWhen FATCA was snuck countries in the world have entered into separate agreements with the Treasury Department that vary widely. The biggest bank in a\ngiven country will probably have the funds and the English language savvy necessary\nto hire American consultants. It can then use FATCA compliance as a bludgeon\nagainst all its smaller local rivals. Please don’t get the impression\nthat this is a well thought-out piece of legislation. \u0026nbsp;This is the first\ntime the United States has tried to re-write the world’s banking laws, and the\nimplementation has predictably been a disaster.\u0026nbsp;\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nWhen FATCA was snuck into law\nin 2010, as a little discussed add-on to the \u003Ca href=\"http:\/\/www.lorman.com\/newsletters\/article.php?article_id=1521\u0026amp;newsletter_id=322\u0026amp;category_id=6\u0026amp;topic=CPA\"\u003EHIRE Act\u003C\/a\u003E, there was no mention of\ninternational agreements. They are a response to the outcry that followed\nEurope’s initial reading of the FATCA legislation. The US treasury department\nhas spent the past two years signing these agreements with foreign governments.\nMany of the agreements promise that information on foreign accounts in US banks\nwill be shared with foreign governments, with no discussion or approval from\nCongress. This approval is unlikely to be forthcoming. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cb\u003E\u003Cu\u003E\u003Cspan style=\"color: red;\"\u003EWhite Hat Republicans?\u003C\/span\u003E\u003C\/u\u003E\u003C\/b\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nWhich is where the Republicans come in. Last month they\nadded opposition to FATCA to the party’s platform, which inspired Nomad\nPolitics’ initial coverage of this issue. Don’t worry, they aren’t being good\nguys on this. They did not decide to oppose the legislation out of sympathy\nwith blue collar Canadian Americans, or an acknowledgement that the US should\nnot be writing laws for other countries. The Republicans have gotten involved\nbecause the Treasury Department did more than they expected with the\nintergovernmental agreements. The many US banking lobbies initially decided\nFATCA was not something they cared about because it excluded all US banks from\noversight. The Treasury department has changed that.\u0026nbsp;\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv style=\"text-align: justify;\"\u003E\nIn many of the  intergovernmental agreements (IGA) that they have been signing they have agreed to share US information with foreign banks.  Now the banks are interested. It is only now, when it has become clear that US banks might have some burdens imposed on them, that the Republican party is choosing to act.\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nMy prediction is that the Republicans will be unable to\ncancel FATCA. The simple narrative of “we’re going after tax cheats!” is just\ntoo powerful. At the end of the day, Republicans love the idea of world-wide\nimperial power just as much as the Democrats do. FATCA will probably survive. What\nI think the Republicans will manage to do, however, is take any reciprocity out\nof the international agreements that the Treasury Department has been signing.\nFATCA will go forward as initially designed, with the US forcibly collecting\ninformation from everyone in the world, and sending information back to nobody.\nThe United States will go from being the largest tax haven in the world, as it\ncurrently is, to the \u003Ci\u003Eonly \u003C\/i\u003Etax haven in the world. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nThis removal of the last shred of self-respect we left to\nforeign signatories of international agreements will probably be swallowed. But\nit will be remembered. This leads me to the first of what I believe will be the\nhistorical consequences of FATCA.\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cspan style=\"color: red;\"\u003E\u003Cu\u003E\u003Cb\u003EBlowback\u003C\/b\u003E\u003C\/u\u003E\u003C\/span\u003E\u003Cbr \/\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nReaders of Nomad Politics are no doubt familiar with the\nconcept of “Blowback”. The idea is that the actions of the US military will\nhave consequences for the American public down the line in terms of terrorism\nor other forms of attack. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nI don’t think newly unemployed Swiss bankers are going to\nstart strapping on bomb vests. They will remember though. They’ll end up in\nsome other industry, but they will remember. Foreign governments will swallow\ntheir embarrassment over what they were forced to sign and will move on, but\nthey will remember. Every time someone has to fill out a bank account opening\nform, anywhere in the world, and asks why she has to swear she is not a US\ncitizen, she will have US dominance shoved in her face. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nAs FATCA shows, the US is still the top dog. Nobody without\nhegemonic power would be able to pull off something this offensive. This\ndominance is slipping away year by year. Even as the US gets richer, it loses\nstanding in proportion to the rest of the world’s wealth. A day will come when\nthe US doesn’t get to automatically get its way when discussing financial\nissues. It may not be the Euro or the Renminbi, but someday there will be\nanother reserve currency.\u0026nbsp;\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nWhen that day comes, the rest of the world will\nremember how the US used its hegemonic power. The reckoning will not come in a\nterrorist attack. It will come in a quiet, legal, way that most Americans won’t\neven notice. \u0026nbsp;Nobody will die. It is already hitting our\nwallets, and it will soon be hitting our collective knowledge. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nThe negotiation of most large international financings now\nincludes a detailed discussion of who bears the risk of FATCA legislation.\nPeople will still want money from large American banks for decades to come. As\nwe move farther down the scale though, individual businessmen (laid off Swiss\nbankers, perhaps?) have already started asking themselves questions. “Can I\nsell my goods to Europe instead of the US so I can avoid this payment\nuncertainty? If I let an American investor into my business, will that make me\nvulnerable to this FATCA garbage?” This effect will not be immediately obvious,\nbut it will make a mark.\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nThe future of the world is global. Massive corporations,\nsmall investors, and individual employees are all stepping out onto the global\nstage. The large money contracts are all made at the top end by banks and oil\ncompanies. The US will not suffer in those sectors for some time. But the\nthousands, or millions of smaller transactions are just as important for\ninnovation, and building an understanding of the world beyond a nation’s\nborders. Banana Republic Russia has big banks and oil companies. It is the\nthousands of smaller companies that make the US a world class economy. FATCA\nhurts those companies. \u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nThe US is the only developed country that taxes its citizens\nabroad. People make much of the fact that the US does not start taxing its\nex-pat citizens on the first $92,000 of income. Folks making that much should\nhave the wherewithal to pay taxes to two countries, the argument goes. They\nmight be able to, but they won’t for long. They will simply move back to the\nUS, where they don’t have to deal with double taxation. Americans will found\nbusinesses at home instead of abroad. The opportunities of a globalized world\nwill start to go to other countries.\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\n\u003Cbr \/\u003E\u003C\/div\u003E\n\u003Cdiv class=\"MsoNormal\" style=\"text-align: justify;\"\u003E\nAmericans won’t want to build careers or businesses\noverseas. They will do a semester abroad, or maybe do a drunken year teaching\nEnglish in their early 20s. As an ex-pat myself, I have often noted that\ninternational travel is wasted on the young. A college student barely knows his\nown country, how can he learn about another? As a country we will do less and\nless business with the world outside, and know less and less about it.
